File a claim with Ebay. At least it will go on his record. Pesonally I would pose that to him and make him cover your total costs. This is no different than going to a store to buy something. Its a legal binding contract and you do have rights.
The guy is making it as right as he can, don't drag him through the mud.
It is a used part. It is different than going to the store.
Caveat emptor.
I would have made him take the bellhousing off for inspection though.
The seller doesn't have to warranty anything unless it is explicitely expressed as having a warranty and was sold as beiong fit for use.
I try to take care of my customers though if something like that has happened as you well know Steve......
Trouble is I still took it in the backside on that deal.......

Gary, I agree with you to a point. It is true that it is a used part and buyer should be aware. However in reality its not usable and without an Internal Inspection the buyer would not have known at time of purchase. Based on the purchase price I dought the seller prempted his add with "condition unknown" or something on that line. I have no access to the add so I can not confirm. The buyer should not have to incur any cost here.
Our situation would not be a good comparitive considering you sent me a good usable unit that got damaged in transit. You made good on it and it was appreciated and have spread the word you are a good man to deal with. I too have taken it in the backside on a lot of deals in my life to preserve my Integrity. Its what we do.
I don't disagree that they seller needs to help out with this but he shouldn't be blackballed because of it.
On your w/c tranny, I got that from a guy that deals in VW stuff all the time.
He sold it to me as being a good take out.
He hasn't done anything about it but tell me "sorry".
I am assuming the eBay seller bought this and flipped it w/o any inspection.
Kinda the same thing.
There was no shipping on yours if you recall.
A customer of mine brought it to you in Wellsville.
When it turned out bad, Brian Drew took the replacement with him from me to the Lansing show and you swapped them out there.
I still have that basket case..........
